After consulting with numerous doctors, the Cates felt this was a safe way to deliver their baby since the hospital’s website advertised its expertise in delivering breech babies vaginally.

Unfortunately, things went terribly wrong during the delivery and the Cates’ son, Howie, suffered “catastrophic, permanent, and irreversible” brain damage after a series of mistakes made by the medical team. Mr. and Mrs. Cates are seeking $25.6 million in economic and non-economic damages. Not only did Howie experience seizures, but he also has been diagnosed with cerebral palsy because of the risky procedure.

The Risks Involved With C-Sections

C-sections, which are major abdominal operations, carry risks including breathing problems for the baby and surgical complications for the mother. But for breech babies, doctors generally prefer C-sections, according to a committee opinion by the American Congress of Obstetricians and Gynecologists.
