The staff of an out-of-date child care center in California has been struck with criminal charges over the death of a 4-year old boy in the fall of 2012.

The baby’s parents have filed a wrongful death lawsuit against the former childcare center called Magic Place Children Center in Terra Linda, as well as the owners and two of its employees. As of right now, the parents of Carter Garwood are seeking unspecified damages.

The case began in October 2012 when the employees of the childcare center found Garwood unconscious and dialed 911. Firefighters took the boy to the Kaiser Permanente Medical Center, where he was pronounced dead.
San Rafael Police and the county coroner’s division investigated the baby’s death and ruled that he accidentally suffocated on his bedding.

The three suspects in the case- owner Claudia Gil, 44, and two employees Sandra Del Socoro Alvarado Mendez, 49, and Lorena Huitron-Jiminez, 28, were arrested on accusations of involuntary manslaughter. They have since then been released on bail while prosecutors review the case.

District Attorney Ed Berberian stated that the evidence proved to be misdemeanors. Gil was charged with six counts of violating child care center requirements, specifically failing to provide medical treatment, failing to provide direct visual supervision, false statements, failure to provide adequate staffing, false statements, allowing an employee to provide care without a criminal record clearance, and failure to maintain equipment in safe condition.

The three defendants are set to appear in court on January 23 and could face up to six months in jail if convicted. The state department of Social Services has since then revoked the center’s operating license and banned the three defendants from working at any licensed facilities in the future.
